Account Creation

To use the Service, you must create an account by providing accurate, current, and complete information. You agree to:

• Provide truthful and accurate registration information

• Maintain and update your information to keep it accurate

• Be responsible for all activity under your account

• Not create multiple accounts for fraudulent purposes

• Not share your account with others

Account Security

You are responsible for maintaining the security of your account credentials. You agree to:

• Choose a strong, unique password

• Keep your password confidential

• Enable two-factor authentication when available

• Notify us immediately of any unauthorized access or security breach

• Accept responsibility for all activities conducted through your account

We are not liable for any loss or damage arising from your failure to protect your account credentials.

Subscription Plans

Postprism offers multiple subscription tiers (Free, Pro, Enterprise) with varying features and limitations. Current pricing and features are available on our Pricing page.

Billing Terms

• Subscriptions are billed in advance on a monthly or annual basis

• All fees are in U.S. Dollars unless otherwise stated

• Payment is due upon subscription activation and each renewal date

• You authorize us to charge your payment method automatically

• Fees are non-refundable except as required by law or stated in these Terms

Price Changes

We may change subscription prices at any time. We will provide at least 30 days' notice before any price increase takes effect. If you do not agree to the price change, you may cancel your subscription before it renews at the new price.

Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused services, except:

• If we terminate your account without cause

• If required by applicable law

• If we determine a refund is appropriate on a case-by-case basis

Free Trial

We may offer free trial periods for certain subscription plans. If you do not cancel before the trial ends, your payment method will be charged for the subscription. Trial eligibility is determined at our sole discretion, and we reserve the right to limit trials to one per user.

Prohibited Content

• Publish illegal, harmful, threatening, abusive, harassing, defamatory, or hateful content

• Violate intellectual property rights of others

• Share false, misleading, or deceptive information

• Distribute malware, viruses, or other harmful code

• Publish content that violates privacy rights or contains personal data without consent

• Share sexually explicit or obscene content

• Promote violence, terrorism, or illegal activities

Prohibited Activities

• Use the Service to spam, phish, or engage in fraudulent activities

• Attempt to gain unauthorized access to our systems or other users' accounts

• Reverse engineer, decompile, or disassemble the Service

• Use automated tools or bots to access the Service (except our official API)

• Circumvent usage limits, security measures, or access controls

• Resell or redistribute the Service without authorization

• Interfere with or disrupt the Service or servers

• Violate any applicable laws or regulations

Compliance with Platform Policies

When publishing content to third-party social media platforms through Postprism, you agree to comply with each platform's terms of service, community guidelines, and content policies. Violations of platform policies may result in content removal, account suspension, or termination of your Postprism account.

Enforcement

We reserve the right to investigate and take appropriate action against users who violate this Acceptable Use Policy, including:

• Removing prohibited content

• Suspending or terminating accounts

• Reporting illegal activities to law enforcement

• Pursuing legal action

Your Content

You retain all ownership rights to content you create, upload, or publish through the Service ("User Content"). By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

• Store, process, and transmit your User Content to provide the Service

• Publish your User Content to third-party platforms as instructed by you

• Create backups and ensure data redundancy

• Analyze your User Content to improve AI features (in aggregate, anonymized form)

Content Responsibilities

You are solely responsible for your User Content and the consequences of publishing it. You represent and warrant that:

• You own or have the necessary rights to use and publish your User Content

• Your User Content does not violate these Terms or applicable laws

• Your User Content does not infringe upon the rights of third parties

• You have obtained all necessary consents, licenses, and permissions

Content Moderation

We reserve the right, but have no obligation, to monitor, review, or remove User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We do not pre-screen User Content and are not responsible for content posted by users.

Data Export and Deletion

You may export your User Content at any time through the Service. If you delete your account, we will delete your User Content within 30 days, except where retention is required by law or necessary for legitimate business purposes.

Our Intellectual Property

The Service, including its design, functionality, software, algorithms, trademarks, and content (excluding User Content), is owned by Postprism and protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works of the Service

• Use our trademarks, logos, or branding without permission

• Remove or alter copyright notices or proprietary markings

DMCA and Copyright Complaints

We respect intellectual property rights. If you believe your copyright has been infringed, please contact our DMCA agent at dmca@postprism.com with:

• Identification of the copyrighted work

• Location of the infringing material

• Your contact information

• A statement of good faith belief that use is not authorized

• A statement that the information is accurate

• Your physical or electronic signature

Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account through account settings. Upon termination:

• Your subscription will remain active until the end of the billing period

• Your User Content will be deleted within 30 days

• You will lose access to the Service and your data

Termination by Us

We may suspend or terminate your account immediately, without prior notice or liability, if:

• You violate these Terms or our Acceptable Use Policy

• Your account is involved in fraudulent or illegal activity

• You fail to pay subscription fees

• We are required to do so by law

• We discontinue the Service (with 30 days' notice and pro-rata refund)

Effect of Termination

Upon termination, all rights granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) will continue to apply.

Service Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

Terms Changes

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. We may also send email notifications for significant changes.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of state and federal courts located in San Francisco County, California.

Dispute Resolution

For any dispute arising from these Terms or the Service, you agree to first contact us at legal@postprism.com to attempt informal resolution. If we cannot resolve the dispute within 60 days, either party may pursue formal dispute resolution.

Arbitration Agreement

Except for small claims court matters and intellectual property disputes, any dispute will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in San Francisco, California, and judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver

You agree to resolve disputes with us on an individual basis only, and not as part of any class or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements you enter into with Postprism, constitute the entire agreement between you and Postprism regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms does not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
